The New Jersey Motor Vehicle Commission (MVC) just sent you a notice. It intends to suspend your New Jersey driving privileges. What should you do?

The worst thing you can do is to do nothing. Unless you respond, the MVC will suspend your license as promised. Your position is much stronger if you have your drivers license and MVC is trying to suspend it, than if MVC has suspended your drivers license and you are trying to get it restored.NJ license New Jersey Motor Vehicle Commission MVC NJMVC drive driver drivers suspend revoke months years

In responding to drivers license issues, time is a precious resource. If you have a lawyer, he will need time to analyze your situation and determine an appropriate course of action. He will need time to prepare for conferences and hearings. What this preparation will consist of will depend on the particular situation that puts your right to drive in jeopardy.

You can lose your New Jersey driving privileges in either of two ways. The first way is for a judge to order that your license be suspended. The second way is that the New Jersey Motor Vehicle Commission orders the suspension. The net effect is the same. But the way of fighting whether the suspension will be imposed is very different, depending on which of the two ways is involved.

Excess points are just one of the ways that the Motor Vehicle Commission can challenge your ability to keep your drivers license. Drivers license issues can arise in many other ways. Sometimes the Motor Vehicle Commission tells you that you must undergo medical tests, or provide medical documentation. Sometimes the Commission wants you to take a vision test, or retake a road test, all over again. But the Motor Vehicle Commission itself must follow the rules. Very often it does not. Unless you know how to challenge what Motor Vehicle Commission has done, and how it has done it, your right to drive is at very high risk.

A drivers license is a necessity. If your drivers license is in danger, you should consult with a qualified legal professional as quickly as possible. Your lawyer can tell you what result you can realistically expect. The lawyer you select should be one who is familiar with this specialized area of the law.
